Two New Attorneys Join CML, Expanding its Estate and Business Law Practice

The Law firm of Clark, Mize & Linville, Chtd., is pleased to announce that Jessica L. Stoppel recently joined the firm as a lateral associate practicing primarily in the areas of estate planning and business law.  The firm also recently hired new associate Jeffrey A. Norris who will practice in the areas of estate planning, probate and trust administration, business planning, real estate and employment law.

Originally from Gorham, Kansas, Jessica received her Bachelor of Science degree from Kansas State University and her Juris Doctorate from the University of Denver Sturm College of Law.  Before joining the firm, Jessica was in private practice with an estate planning law firm in Dodge City, Kansas for the past three years.

Jessica and her husband, Blake Stoppel, reside in Salina with their two dogs, Bella and Mack.

A Salina native, Jeffrey A. Norris received his Bachelor of Science degree (summa cum laude) and Master of Arts degree from Kansas State University. His Juris Doctorate (cum laude) was received from Washburn University School of Law.  Prior to going to law school and joining the firm, Jeff worked in NCAA Compliance for K-State Athletics.

Jeff and his wife, Laine Norris, reside in Salina.

Supreme Court Appoints Peter Johnston to Kansas Board of Law Examiners

The Kansas Supreme Court has appointed Peter S. Johnston of the firm to the Kansas Board of Law Examiners for a five-year term that starts July 1, 2016.

The 10-member Kansas Board of Law Examiners is composed of both judges and lawyers. It manages and grades a twice-yearly bar examination and conducts hearings on applicants’ character as well as fitness to practice law. It also makes recommendations to the Supreme Court on policies and procedures related to bar admission.

Clark, Mize & Linville Announces Three New Shareholders

Clark, Mize & Linville, Chartered is pleased to announce that Jared T. Hiatt, Joshua C. Howard, and Aaron O. Martin have become shareholders in the firm.

Jared Hiatt’s practice emphasizes employment law, civil litigation, workers compensation and insurance defense.  Jared advises clients on a full range of employment law issues and represents employers in the defense of employment related claims. He also represents a variety of individuals, businesses and insurance companies in all forms of litigation.  Jared, a Salina native, is a graduate of the University of Kansas School of Law and has been with the firm since 2008.  He is a member of the Kansas Association of Defense Counsel, Defense Research Institute, Association of Defense Trial Attorneys and Society for Human Resource Management.  Locally, Jared is a member of the Saline-Ottawa County bar association and is currently president of the board of directors of the Salina Community Theatre.  He and his wife, Alison, have a 16-month-old daughter, Caroline. 

Josh Howard concentrates his practice in estate planning, estate and trust administrations. He also practices in business and commercial law, real estate transactions, taxation, and agricultural law.  He enjoys working with clients to construct and implement trusts, wills, and estate plans to best meet their needs.  Josh also assists clients with the formation and ongoing operations of corporations, limited liability companies, and related businesses.  Josh has been with the firm since 2009 after graduating with Highest Distinction from the University of Nebraska College of Law.  Josh is on the board of directors of the Ashby House and is a member of First Covenant Church.  He and his wife, Jill, have a 3-year-old daughter, Elizabeth, and a five-month-old son, Luke.

Aaron Martin, a Salina native, joined the firm in 2010.  He has a diverse practice and represents individuals and entities in a variety of matters involving real estate, business, banking, and municipal law.  Aaron is a 2009 magna cum laude graduate of Washburn University School of Law and a former editor of the Washburn Law Journal.  He received his undergraduate degree, with an emphasis in finance, from Kansas State University.  Aaron enjoys calling Salina home with his wife, Jessica, and serves as a member of the board of directors of Big Brothers Big Sisters of Salina, Inc. and the Salina Family YMCA, Inc.

Defense Verdict Obtained in Products Liability Case

Dustin J. Denning successfully defended our client, a hydraulic cattle chute manufacturer, in a jury trial in which the plaintiff alleged that a defect in design, manufacture and inspection/testing caused an o-ring to fail and forcefully spray hot hydraulic oil which caused an injection injury to his face.  The plaintiff alleged permanent scarring and disfigurement to his face, along with pain and suffering.  His claims included negligence, strict liability, breach of implied warranty, and breach of implied warranty of fitness for a particular purpose.  The plaintiff asked for just over $250,000 at trial.

We successfully argued that the plaintiff failed to present evidence of a design defect in the product.  We also established through expert testimony that the o-ring failure had nothing to do with something the manufacturer did or failed to do.  We argued that the manufacturer exercised ordinary care in the design of the Chute so that it would be reasonably safe for the use for which it was intended or which could reasonably be anticipated.  We also argued that the manufacturer made a reasonable inspection of the Chute for any defect, and that the manufacturer provided adequate warnings of such dangers which it reasonably anticipated.

After a three day jury trial, the Cloud County, Kansas, jury returned a unanimous verdict in favor of our client after deliberating about 1 hour and 20 minutes.

Defense Verdict Obtained in Medical Malpractice Case

Dustin J. Denning successfully defended our client, an orthopedic surgeon, in a jury trial in which the plaintiff alleged that the doctor was negligent in diagnosing, recommending and performing an open reduction internal fixation (ORIF) of the plaintiff’s left ankle syndesmosis disruption because it was allegedly not indicated based upon the plaintiff’s history, physical exam or the x-rays.  The plaintiff also alleged that our client failed to timely respond to her post-surgical complaints of splint and cast tightness which allegedly resulted in a compression injury to her superficial peroneal nerve and saphenous nerve.  She alleged permanent injury, including numbness and tingling, to the lower leg, ankle and foot.  The plaintiff also alleged injury to her low back under the “altered gait” theory.  Plaintiff sought over $450,000.00 at trial.

We successfully argued that the doctor made an appropriate diagnosis and offered an appropriate surgery that the plaintiff elected to have in order to treat her chronic ankle pain.  We also successfully argued that the doctor timely responded to plaintiff’s complaints of splint/cast tightness, numbness and tingling.  Our foot/ankle surgeon expert opined that the plaintiff’s condition was that of a tension neuropathy that was caused when the syndesmosis disruption was reduced by our client.

After a five day jury trial, a Riley County, Kansas, jury returned a verdict in favor of our client after deliberating about 35 minutes.
